On January 31, a Varanasi district court issued a significant ruling granting the family of a priest the right to conduct worship rituals for Hindu deities within the confines of the Vyas Tekhana area located inside the Gyanvapi mosque complex. The decision, delivered by District Judge Ajay Krishna Vishwesha, also mandated the District Magistrate to take possession of the basement and oversee the initiation of worship rituals within the forthcoming seven days.

Advocate Vishnu Shankar Jain, representing the Hindu party, elucidated that the court’s verdict authorizes the priest’s relatives to engage in deity worship within the Gyanvapi mosque cellar. This development marks a pivotal moment, allowing Hindu devotees the privilege to conduct prayers at ‘Vyas Ka Tekhana’, with the onus on the District Administration to facilitate necessary arrangements within the stipulated timeframe.

The Gyanvapi mosque compound encompasses four cellars in its basement, one of which remains under the ownership of the Vyas family. The legal recourse, spearheaded by Shailendra Kumar Pathak, sought to reinstate the right to perform religious rites in the cellar, which had been discontinued in 1993 following governmental directives.

However, in response to the court’s decree, a mosque committee has expressed its intent to challenge the ruling in the Allahabad High Court, signifying a potential legal contestation over the matter. Advocates advocating for the Hindu side hailed the judgment as historically significant, drawing parallels to the landmark 1986 order to unlock the gates of the Ram Mandir.

Advocate Subhash Nandan Chaturvedi, another legal representative advocating for the Hindu cause, emphasized the court’s directive mandating compliance within a week, underscoring the urgency of the situation. Following the court’s pronouncement, petitioners and their legal representatives gestured victory signs, symbolizing their contentment and approval of the court’s decision.

What is Vyas ka Tehkhana?

“Vyasji ka Tehkhana” is a cellar within the Gyanvapi mosque complex. Out of the four cellars in the mosque, one belongs to the Vyas family who used to live there. Shailendra Kumar Pathak Vyas filed a lawsuit against the committee managing the mosque, asking the court to appoint the district magistrate as the caretaker of this cellar. This shows a disagreement over who controls and uses the space within the mosque.

Muslim to appeal in high court

The legal battle over the Gyanvapi mosque complex continues as the Muslim side announces plans to appeal the district court’s recent ruling. Anjuman Intezamia Masjid Committee’s counsel, Akhlaque Ahmad, affirmed their intention to challenge the order in the higher court, emphasizing that the cellar in question remains an integral part of the mosque and should not be utilized for Hindu worship.

Ahmad’s statement follows a series of developments, including a plea by four Hindu women to the Supreme Court requesting excavation and scientific examination of a sealed section within the mosque. This request comes in light of an Archaeological Survey of India (ASI) report suggesting the existence of a pre-existing Hindu temple beneath the mosque’s construction.
